Over 65 acres in Devine may be rezoned Class G Retail Districts


The Planning & Zoning Commission will hold a Public Hearing on the Preliminary Report for lots of zoning changes (which can be seen here), and will create a Final Report for the City Council at a public meeting on Monday, January 8th, 2018 at 7:00 p.m. at Devine City Hall.Then The City of Devine will hold a Public Hearing on the Final Report of the Planning & Zoning Commission regarding the zoning changes during the public meeting held on Tuesday, January 16th, 2018 at 6:00 p.m.
The zoning changes in the public notice include:
1. Discuss and consider a zoning classification change for approximately 41.6731 acres of land starting at north and south Upson Drive along Hondo Avenue W to include southern border of College Avenue & S Windy Knoll and to include north east Upson & Park Avenue in the City of Devine from the recommended study of comprehensive plan, and create a Preliminary Report regarding changing the zoning classification of this area from Class A. Single-Family Residence to Class G. Retail Business District and which is proposed to include any or all properties described on page 5.
2. Discuss and consider a zoning classification change for approximately 5.7174 acres of land starting at north and south Upson Drive along Hondo Avenue W to include southern border of College Avenue & S Windy Knoll and to include north east Upson & Park Avenue in the City of Devine from the recommended study of comprehensive plan, and create a Preliminary Report regarding changing the zoning classification of this area from Class D. Two-Family Residence to Class G. Retail Business District and which is proposed to include any or all properties described on page 5.
3. Discuss and consider a zoning classification change for approximately 21.2992 acres of land starting at north and south Upson Drive along Hondo Avenue W to include southern border of College Avenue & S Windy Knoll and to include north east Upson & Park Avenue in the City of Devine from the recommended study of comprehensive plan, and create a Preliminary Report regarding changing the zoning classification of this area from Class F. Neighborhood Shopping Center to Class G. Retail Business District and which is proposed to include any or all properties described on page 5.
According to the public notice (which can be read in its entirety on page 5), “Any person desiring to speak in favor of or against the change to the zoning classification as described above may appear before the Planning & Zoning Commission and/or the City Council at the Public Hearings listed above and/or may provide a written statement, including their name, address, and phone number, to the City Secretary prior to the date of the Public Hearing. For there to be a valid protest, it must be in writing and signed by the owners of at least 20% of either:
The *area of the lots or land covered by the proposed zoning change; or
The *area of the lots or land immediately adjoining the area covered by the proposed change and extending 200 feet from that area.
*In computing the land area, the area of streets and alleys shall be included. (LGC Sec. 211.006(e))
If the proposed zoning change is protested as described above, in order for the zoning change to take effect, an affirmative vote of at least three-fourths of the city council must be received.”
