Recount ordered in District 2 election

The Devine City Council canvassed the results of the May 4 General Election and ordered an automatic recount in the District 2 race between incumbent Steve Lopez and challenger Kristabel Aguero during a Special meeting held May 14.
Aguero and Lopez each received 25 votes in the General Election.
Interim City Administrator Dora Rodriguez said that three people agreed upon by Lopez, Aguero, and the City will recount the ballots.
“All we’ve got to do is pick someone who’s agreeable to [Aguero and Lopez],” Mayor Bill Herring said.
According to Section 2.002 of the Texas Election Code, if the race is still tied after the recount, a second election cannot be held earlier than the 20th day or later than the 30th day after the date the recount or its canvass is completed.
Section 4.003 of the Code states that public notice of the date of the second election must be given no earlier than the 30th day or later than the 10th day before Election Day.
